As between Bytebis and the Customer, the Customer retains ownership and control of its Customer Business Data, subject to the rights necessary for Bytebis to provide the Service.

Bytebis processes Customer Business Data primarily to provide the Service requested by the Customer.

The Customer is responsible for:

  • determining what information is entered into the Service;
  • ensuring that the information is accurate and lawful to process;
  • obtaining required permissions or consents where applicable;
  • providing appropriate privacy notices to individuals whose data is entered into the Service;
  • configuring user access appropriately; and
  • complying with applicable data-protection, accounting, tax, employment, and other legal requirements.

5. Personal Data Submitted by Businesses

A Bytebis customer may use a Service to process personal data relating to its own customers, suppliers, employees, or other individuals.

In such situations, Bytebis generally processes that information on behalf of the Customer for the purpose of providing the applicable Service.

The Customer remains responsible for determining the lawful basis and purpose for collecting and using such personal data and for providing required notices and obtaining required permissions where applicable.

Bytebis may process such information only as reasonably necessary to provide, secure, maintain, support, and improve the applicable Service, or as otherwise required or permitted by law.

6. Legal Bases and Permitted Processing

Depending on the applicable law and circumstances, Bytebis may process personal data based on:

  • your consent;
  • the performance of a contract or provision of a requested Service;
  • compliance with legal obligations;
  • legitimate operational and security purposes where permitted by applicable law; or
  • other lawful grounds available under applicable law.

Where processing is based on consent and applicable law provides a right to withdraw that consent, you may withdraw consent using the available mechanism or by contacting us.

Withdrawal of consent does not necessarily affect processing that was lawfully completed before withdrawal.

Bytebis Services may use or integrate with Third-Party Services.

  • cloud hosting and infrastructure providers;
  • database and storage providers;
  • authentication providers;
  • payment processors;
  • email and SMS providers;
  • analytics providers;
  • customer-support systems;
  • AI and machine-learning providers;
  • communication platforms;
  • mapping and location providers;
  • app stores;
  • security and monitoring services; and
  • other technology providers required to operate the Service.

These providers may process information on our behalf or, depending on the integration, may process information under their own terms and privacy policies.

We seek to use third-party providers that provide appropriate security and privacy protections for the services they provide to us.

The privacy practices of a third-party service may differ from those of Bytebis. You should review the applicable third party’s privacy policy where relevant.

8. Authentication Services

Some Bytebis Services may support authentication through third-party identity providers such as Google, Apple, Meta etc.

When you choose such an authentication method, information necessary to authenticate your Account may be exchanged between Bytebis and the relevant identity provider.

Bytebis does not receive or store your third-party account password through such authentication mechanisms.

Your use of the third-party identity provider remains subject to that provider’s own privacy policy and terms.

9. Payment Information

Where a Service requires payment, transactions may be processed through third-party payment providers.

Depending on the payment method and provider, Bytebis may receive information such as:

  • payer name;
  • billing information;
  • transaction identifier;
  • payment status;
  • amount paid;
  • currency;
  • subscription information; and
  • limited payment-related information.

Payment-card or banking credentials may be collected and processed directly by the relevant payment provider rather than by Bytebis.

Bytebis does not intentionally store complete payment-card credentials unless expressly stated for a particular Service and handled in accordance with applicable security requirements.

10. Artificial Intelligence and Automated Processing

Some Bytebis Services may provide artificial intelligence, machine-learning, automated analysis, recommendations, summarisation, reporting, or similar functionality.

Depending on the feature, information submitted for such functionality may be processed by Bytebis and/or an external AI service provider.

Where external AI providers are used, information may be transmitted to those providers to perform the requested function.

Bytebis will take reasonable steps to configure such integrations appropriately for the intended use of the Service.

Customers should avoid submitting highly sensitive or unnecessary personal information to AI features unless the relevant Service specifically supports such processing.

AI-generated outputs may be inaccurate and should be reviewed before being relied upon.

11. Analytics

Bytebis may use analytics and monitoring technologies to understand how its websites and Services are used and to improve reliability and performance.

Analytics information may include:

  • device and browser information;
  • approximate geographic information;
  • pages or features accessed;
  • session information;
  • application events;

Where appropriate, Bytebis may configure analytics systems to reduce the collection of information that is not necessary for analytics purposes.

Bytebis does not sell Customer Business Data or personal data to third parties for their independent advertising purposes.

Service Providers

We may share information with vendors and service providers that perform services on our behalf, such as hosting, storage, authentication, analytics, communications, customer support, security, payments, and AI processing.

Customer-Directed Integrations

Where you intentionally connect a third-party service or integration, information may be transferred according to your instructions and the functionality of that integration.

Legal Requirements

We may disclose information where reasonably necessary to:

  • comply with applicable law;
  • respond to valid legal processes;
  • comply with lawful requests from authorities;
  • protect the rights, property, or safety of Bytebis, users, or others; or
  • investigate fraud, abuse, security incidents, or unlawful activity.

Depending on the Service, security measures may include:

  • authentication mechanisms;

  • secure cloud infrastructure;

  • backup and recovery mechanisms;
  • software updates and security patches; and
  • measures intended to detect and respond to security incidents.

However, no internet-based system or method of electronic storage can be guaranteed to be completely secure.

You are responsible for protecting your Account credentials, devices, networks, and user access.

14. Data Retention

Bytebis retains information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • provide the Services;
  • maintain Account functionality;
  • comply with legal obligations;
  • resolve disputes;
  • enforce agreements;
  • maintain security;
  • prevent fraud and abuse; and
  • maintain appropriate business and financial records.

The retention period for Customer Business Data may depend on the applicable Service, subscription, account status, backup system, and technical architecture.

After Account termination, Customer Business Data may remain temporarily available or retained in active systems, backups, archives, or logs for a limited period.

When information is no longer required, Bytebis may delete, anonymise, or otherwise dispose of it in accordance with its retention practices and applicable law.

15. Customer Data Export and Deletion

Where a Service provides data-export functionality, Customers may export available Customer Business Data before terminating their Account or Service.

Customers should maintain independent copies of important business information.

A request to delete an Account or personal information does not necessarily require Bytebis to immediately delete every copy from backups, security logs, financial records, legal records, or other systems where retention is required or reasonably necessary.

Where information must be retained for legal, security, fraud-prevention, dispute-resolution, or other legitimate purposes, Bytebis may retain the information for the applicable period.

16. Data Loss and Backups

Bytebis may maintain backups and recovery systems for operational and disaster-recovery purposes.

However, Bytebis’s backups are not intended to replace the Customer’s own independent backups of important business information.

Customers are responsible for maintaining appropriate independent copies or exports of business-critical information.

Bytebis does not guarantee that every item of Customer Business Data can always be recovered following accidental deletion, corruption, infrastructure failure, security incidents, third-party failures, or other events.

Additional provisions concerning Customer responsibility for backups and data loss are contained in our Terms and Conditions.

17. International Data Processing

Bytebis and its service providers may process or store information in countries other than the country in which you are located.

This may occur because our infrastructure, hosting providers, support providers, analytics providers, payment providers, AI providers, or other technology providers operate internationally.

Where applicable law imposes requirements concerning cross-border transfers or international processing, Bytebis will take reasonable steps to comply with those requirements.
